In addition to the price, location, floor area or condition of the property, there is another aspect we should not overlook: its legal status.<\/p>\n<p>The Land Registry allows us to find out who is recorded as the owner of a property and whether there are any registered charges or rights that could affect it. Checking this information before buying helps us make decisions with greater confidence.<\/p>\n<p>But what information can we find there? Is it compulsory to register a property? How long does the process take? We explain the main points in simple terms.<\/p>\n<h2>What is the Land Registry?<\/h2>\n<p>The Land Registry is a public institution whose main function is to record certain rights and legal circumstances relating to real estate, as well as to protect registered rights.<\/p>\n<p>Put simply, it allows us to check who is recorded as the owner of a property and which rights or charges are registered against it.<\/p>\n<p>For example, it may contain information about ownership, mortgages, court-ordered attachments or usufruct rights. This information is especially useful when we are buying a home and want to check its registration status before completing the transaction.<\/p>\n<h2>Why is it important to check the Land Registry before buying a home?<\/h2>\n<p>When we find a property we are interested in, we should not only check that it meets our expectations. It is also advisable to review the ownership details and charges registered against it.<\/p>\n<p>Checking the registry information allows us to verify:<\/p>\n<ul>\n<li>Who is recorded as the owner of the property.<\/li>\n<li>Whether there are multiple owners.<\/li>\n<li>Whether a mortgage is registered.<\/li>\n<li>Whether there are any registered court-ordered attachments or other charges.<\/li>\n<li>Whether there are any registered rights or restrictions that could affect the property.<\/li>\n<\/ul>\n<p>Knowing these details helps identify issues that should be clarified before buying and avoid surprises during the sale and purchase process. This check should be accompanied by a review of the property&#8217;s other documentation.<\/p>\n<h2>What is a nota simple?<\/h2>\n<p>A nota simple is one of the most common documents used to check information about a property. It is an informative document that summarises the main details recorded in the Land Registry for a property.<\/p>\n<p>The information it may contain includes:<\/p>\n<ul>\n<li>The identification and registered description of the property.<\/li>\n<li>The ownership details.<\/li>\n<li>Registered charges and encumbrances.<\/li>\n<li>Other rights or restrictions recorded in the Land Registry.<\/li>\n<\/ul>\n<p>For this reason, requesting a nota simple is advisable before buying a home. It is important to pay attention to its issue date, as a property&#8217;s registration status can change.<\/p>\n<h2>Is it compulsory to register a property with the Land Registry?<\/h2>\n<p>In Spain, registering the acquisition of a property with the Land Registry is not generally compulsory.<\/p>\n<p>However, registration offers benefits in terms of legal certainty and protection of the owner&#8217;s rights.<\/p>\n<p>Mortgages require an important clarification: to validly create a voluntary mortgage, it must be executed in a public deed and registered with the Land Registry. This is established in <a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-1946-2453#a145\">Article 145 of the Spanish Mortgage Act<\/a>.<\/p>\n<p>Therefore, although registering a property purchase is not generally mandatory, it is advisable so that the owner can benefit from the protection afforded by registration.<\/p>\n<h2>Land Registry and Cadastre: are they the same thing?<\/h2>\n<p>It is common to confuse the two institutions, but the Land Registry and the Cadastre serve different purposes.<\/p>\n<p>The <strong>Cadastre<\/strong> is an administrative register containing physical, economic and legal information about properties and has, among other functions, an important tax-related purpose.<\/p>\n<p>The <strong>Land Registry<\/strong>, meanwhile, is concerned with making registered rights over properties public and protecting those rights.<\/p>\n<p>Both systems may contain information about the same property, but their functions are different. That is why being listed as an owner in the Cadastre is not the same as having ownership registered with the Land Registry.
